One year on from the Lehman Brothers collapse - the current state of the Australian mining industry

As signs emerge that the global economic crisis is abating and that the so-called ‘green shoots’ of economic recovery are beginning to appear, it is timely to reflect on what implications the global economic crisis has had on the Australian mining sector.

This article examines the current themes and trends in the Australian mining industry which have emerged both in response to, and in some cases in spite of, the events that occurred in late 2008.

Renewable Energy Target Update

• Renewable Energy Target (RET) scheme amendment legislation passed by Federal Parliament.
• 20 per cent of Australia’s electricity generation to come from renewable energy sources by 2020.
• Limited inclusion of Waste Coal Mine Gas in the RET scheme as an eligible energy source that can generate Renewable Energy Certificates (RECs).
• Increased RECs available for hydro, wind or solar household small generation units.
• Shortfall charge increased from $40 to $65 per MWh.
• Partial exemption from RET for emissions-intensive, trade-exposed activities, full detail still to be seen in regulations.
• Future of CPRS still uncertain.

FIRB’s use of conditional approvals in proposals involving Chinese state owned entities

• FIRB has recently approved investments by Chinese state owned entities in two prominent Australian resources companies, OZ Minerals and Fortescue.
• The approvals were granted on a conditional basis. The state owned entities were required to provide undertakings directed at, in the case of OZ Minerals, ensuring the Australian businesses acquired are operated in accordance with commercial objectives and that pricing of output is on arm’s length terms and, in the case of Fortescue, managing conflicts arising from appointments to the Fortescue board.
• These approvals demonstrate FIRB’s willingness to use undertakings to manage any specific national interest concerns arising from a proposal, while ensuring Australia continues to benefit from foreign investment.
